These Terms of Service (“Terms”) govern your access to and use of the Cases Matter Authentication Service (the “Authentication Service”), which is owned and operated by CasesMatter, LLC (“Cases Matter,” “we,” “us,” or “our”). The Authentication Service supports registration, sign-in, passkey management, session management, and account recovery for the Cases Matter platform. By creating an account, registering or using a passkey, signing in, or otherwise using the Authentication Service, you agree to these Terms and the applicable Cases Matter Privacy Policy. If you are using the Authentication Service on behalf of an Organization, you represent that you have authority to bind that Organization to these Terms.

The Authentication Service is the identity and access layer for the Cases Matter platform. It may be used to:
Cases Matter may modify, improve, suspend, or discontinue all or part of the Authentication Service at any time, subject to applicable law and any separate written agreement that governs an Organization’s use of the platform.

Cases Matter uses passkeys based on WebAuthn or FIDO2 or similar passwordless standards. Cases Matter does not store your private key and does not receive biometric templates used locally on your device. You understand and agree that:
You consent to receive electronic communications from Cases Matter relating to the Authentication Service, including email-verification messages, recovery emails, security notices, service notices, and legal notices. You are responsible for keeping your contact information current.
You may use the Authentication Service only in compliance with these Terms and applicable law. Without limiting the foregoing, you may not:
Cases Matter may suspend or terminate your access to the Authentication Service if:
You may stop using the Authentication Service at any time. Termination or suspension of the Authentication Service may also limit access to other Cases Matter services that depend on it.
Your use of the Authentication Service is subject to the applicable Cases Matter Privacy Policy. You acknowledge that Cases Matter processes account, session, and security data as described in that Policy.
THE AUTHENTICATION SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASES MATTER DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. CASES MATTER DOES NOT WARRANT THAT THE AUTHENTICATION SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASES MATTER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE AUTHENTICATION SERVICE OR THESE TERMS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASES MATTER’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE AUTHENTICATION SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) $100; OR (B) THE AMOUNT PAID TO CASES MATTER, IF ANY, FOR THE AUTHENTICATION SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY TO THE EXTENT SUCH LIMITATION IS PROHIBITED BY APPLICABLE LAW.
These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Authentication Service will be brought exclusively in the state or federal courts located in Kansas, except to the extent a different forum is required by non-waivable law.
We may update these Terms from time to time. When we make material changes, we will post the revised Terms with an updated “Last updated” date and may provide additional notice where required by law. Your continued use of the Authentication Service after the effective date of the revised Terms constitutes acceptance of the revised Terms.
